• “Paid Services” refers to all subscription and one-time payment features, including SendGB Extend, SendGB Exceed, and SendGB Extra, as set forth in Section 4.
• “Free Service” refers to the free, basic file transfer service with limited features.

3. ELIGIBILITY AND ACCOUNT CREATION

3.1 Eligibility You must be at least 18 years old (or the age of majority in your jurisdiction) and have legal capacity to enter binding contracts. If you act on behalf of a legal entity, you represent that you have the authority to bind that entity to these Terms.

3.2 Account Creation Certain features (such as subscription management) require an Account. You agree to:

• Provide accurate, current, and complete information.
• Update such information as necessary to keep it current.
• Maintain the security of your password and not share it.
• Accept responsibility for all activity under your Account.

4. DESCRIPTION OF SERVICES

4.1 SendGB Free (No Sign-Up Required)

• ProvideTransfer files up to [5 GB or as specified on the Website].
• Files are stored for up to 90 days, depending on file size. After this period, files are permanently deleted.

4.2 SendGB Extend (Paid Service)

• Extends file storage duration up to 1 year.
• Pay-per-use, no registration required unless otherwise specified.

4.3 SendGB Exceed (Paid Service)

• Send files up to 1 TB in a single transfer (plan-dependent).
• price tiers are available for various transfer size limits.

4.4 SendGB Extra (Paid Subscription)

• Annual or periodic subscription with enhanced features.
• Single transfer size limit up to 500 GB (varies by package).
• Subscriptions are not auto-renewed. Renewal or repurchase is required at term expiration.
• If you do not renew, your subscription will simply expire.

5. FILE SIZE, STORAGE, AND TRANSFER LIMITS

5.1 File Size Limits

• Free Service: Up to 5 GB.
• SendGB Exceed: Up to 1 TB.
• SendGB Extra: Up to 500 GB per transfer (package-dependent).

5.2 Storage Duration

• Free Service: Up to 90 days.
• SendGB Extend: Up to 1 year from upload date.
• SendGB Exceed & SendGB Extra: Retention periods vary—see plan details.

5.3 Automatic Deletion When the applicable retention period ends, files are automatically and permanently deleted from our servers. Download links become invalid and files are not recoverable.

6. PAYMENT TERMS

6.1 Fees and Billing

• We accept various payment methods (e.g., credit card, PayPal) as indicated on our Website.
• Fees for SendGB Extra are payable in advance for your selected period.
• One-time fees for SendGB Extend and SendGB Exceed must be paid before service access.

6.2 Price Changes

• Fees and plan details may change at any time. Announcements will be posted on the Website. It is your responsibility to regularly check for changes. If you disagree with new fees, do not use or renew that Paid Service.

6.3 Non-Automatic Renewal (SendGB Extra)

• SendGB Extra is not automatically renewed. You must manually renew via your Account or as directed on the Website.

6.4. Refund Policy and Request Procedure

• For one-time purchase services such as SendGB Extend and SendGB Exceed: No refunds are available once the service has been used (i.e., files uploaded or the service otherwise commenced).
• For SendGB Extra (membership/subscription packages):
  
  
  • * You may cancel your membership and request a full refund within seven (7) days of the initial payment (“cooling-off period”). In this case, your membership will be canceled and a 100% refund will be issued.
  • * After 7 days (from the 8th day onward), refund or cancellation requests are not accepted.
• If your membership is terminated for violation of these Terms (including illegal or copyright-infringing activities), no refund will be provided at any time.

Refund Request Methods: Eligible users must initiate their refund request using one of the following methods:

(a) Via Email:

• Send an email to info@sendgb.com from the email address associated with your SendGB account.
• The email should include your full name, registered email address, order ID or transaction reference, and a detailed explanation for the refund request.

(b) Via SendGB Extra Account Dashboard:

• Log in to your SendGB account, go to the Account or Subscription section.
• Click on “Cancel Subscription” and complete the refund request form on that page.

7. USER CONTENT AND RESPONSIBILITIES

7.1 Ownership You retain all rights and ownership in the Content you upload. SendGB does not claim ownership of your files.

7.2 License to SendGB By uploading Content, you grant SendGB a limited license to store, process, and transfer your Content as necessary to operate the Services.

7.3 Content Restrictions You agree NOT to upload, post, or transfer any Content that:

• Violates any law or regulation;
• Is hateful, abusive, defamatory, pornographic, or otherwise objectionable;
• Contains child sexual abuse material or exploits minors;
• Encourages or incites criminal conduct;
• Infringes third-party intellectual property rights;
• Contains viruses, malware, or other harmful code.

7.4 Prohibition of Illegal or Copyright-Infringing Content for SendGB Extra Subscribers If we determine that you have used the Services for illegal or copyright-infringing activities, your subscription may be terminated immediately without warning and no refunds will be given.

7.5 AI and Data Usage SendGB does NOT use, analyze, or process user-uploaded data for purposes of AI or machine learning.

7.6 Indemnification You agree to defend, indemnify, and hold harmless SendGB and its affiliates from any claims or damages arising from:

• Your Content or use of the Services;
• Your violation of these Terms;
• Your violation of third-party rights.

8. NO AI TRAINING ON USER DATA

As specified above, SendGB does not use user Content for artificial intelligence or machine learning training purposes.

9. DATA PROTECTION AND PRIVACY

9.1 Privacy Policy Use of the Services is also governed by our Privacy Policy. By using the Services, you confirm that you have reviewed and understand our Privacy Policy.

9.2 Data Retention We store Content for the periods indicated by your plan. After the retention period, your files are permanently deleted from our servers.

10. SERVICE AVAILABILITY AND MAINTENANCE

10.1 Best Efforts and Downtime We strive for continuous availability but do not guarantee uninterrupted or error-free service. Maintenance (planned or emergency) may occur without notice.

10.2 Modifications and Updates We may modify or discontinue features at any time. We are not liable to you or any third party for any changes or discontinuations of any part of the Services.

11. DISCLAIMER OF WARRANTIES

11.1 “AS IS” Basis The Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.

11.2 Third-Party Links and Content We are not responsible for third-party websites or resources linked within our Services.

12. LIMITATION OF LIABILITY

12.1 Exclusion of Certain Damages To the maximum extent permitted by law, SendGB shall not be liable for indirect, incidental, or consequential damages, including loss of data or profits.

12.2 Liability Cap To the extent permitted by law, SendGB’s total liability for any claims relating to these Terms or the Services will not exceed the amount you paid for the relevant Service in the preceding six (6) months.

13. TERM AND TERMINATION

13.1 Term These Terms apply so long as you use or access the Services.

13.2 Termination by User You may stop using the Services at any time. If you have a Paid Service, cancellation is handled as set out in Section 6.4.

13.3 Termination by SendGB We may suspend or terminate your access if you:

• Breach these Terms,
• We suspect fraudulent or abusive activity,
• We discontinue the Services (with reasonable notice when feasible).

13.4 Effects of Termination Upon termination, your right to use the Services ceases immediately. We may delete your files and account data.

14. INTELLECTUAL PROPERTY RIGHTS

14.1 SendGB’s Intellectual Property SendGB and its licensors retain all rights, title, and interest in the Services (excluding Your Content). You may not copy, distribute, modify, or reverse-engineer any part of the Services.

15. INTERNATIONAL USE

15.1 Compliance with Laws You are responsible for ensuring your compliance with local laws, including export controls, data protection, and privacy regulations.

15.2 Geographical Restrictions We do not guarantee that Services are available or appropriate outside Estonia or the European Economic Area.

16. GOVERNING LAW AND DISPUTE RESOLUTION

16.1 Governing Law These Terms shall be governed by the laws of Estonia, without regard to conflict-of-law rules.<

16.2 Dispute Resolution The parties shall attempt to resolve any disputes amicably. If unresolved, disputes shall be subject to the competent courts of Estonia, unless otherwise required by mandatory local law.

17. MISCELLANEOUS

17.1 Entire Agreement These Terms and the Privacy Policy constitute the entire agreement between you and SendGB.

17.2 Waiver Failure to enforce any right under these Terms does not constitute a waiver by SendGB.

17.3 Severability If any provision is deemed invalid, the remaining provisions remain in effect.

17.4 Assignment We may assign these Terms in the context of a merger, acquisition, or by operation of law.

17.5 Force Majeure Neither party shall be liable for delay or failure due to causes beyond reasonable control, such as acts of God, wars, or government actions.
